The truth about women in Islam...Video; Published on Dec 25, 2012 (various narrators...)
Before the advent of Islam longer than 1400 years ago, arabian societies had the costum of burying their own daughters alive out of shame: female infanticide. Islam saved them from this, and raised the position of women in society to a degree that the women of the west at that time could not even dream of. This video explains the various women's rights that Islam guarantees for Muslim women: The Original Call Project is a serie of videos that presents the straight facts about Islam from its sources, the Holy Quran and the preserved teachings of Prophet Mohammed (peace be upon him). |
The following is some Fiqh (islamic Jurisprudence) about marriage rights...This subject is extensive, so what is given is just some brief insight into the many, beautiful rights Islam affords women. Western media, whenever trying to demonize Islam, they always try to use the avenue of oppressed women...Islam and the protection and preservation it calls all muslims too is in order to actualize the best human-beings and thus facilitate the best in society. Islam is unsurpassed in the virtues it delivers to human-beings and to society at large. While in opposition, Western Culture is working to disrobe the dignity and piety of women, and by this they poison the society and future generations to follow...

And if you fear that you will not deal justly with the orphan girls, then marry those that please you of [other] women, two or three or four. But if you fear that you will not be just, then [marry only] one or those your right hand possesses. That is more suitable that you may not incline [to injustice].

And [also prohibited to you are all] married women except those your right hands possess. [This is] the decree of Allah upon you. And lawful to you are [all others] beyond these, [provided] that you seek them [in marriage] with [gifts from] your property, desiring chastity, not unlawful sexual intercourse. So for whatever you enjoy [of marriage] from them, give them their due compensation as an obligation. And there is no blame upon you for what you mutually agree to beyond the obligation. Indeed, Allah is ever Knowing and Wise.

- ”What your right hand possess”, this is an English effort that means, “women in your charge.” In addition, one should remember the time frame of the revelation and the conditions among the inheritors of the revelation that lived with the Prophet s.a.w...Today, this “charge” over women isn’t something that very pronounced, however it would still a modern interpretation for anyone who has none-siblings who are lawful under their care & protection. In non-islamic terms this contextual meaning is in the likeness of one who is married, but then also houses and cares for a mistress...
The prophet s.a.w said, “o young people! Whoever has among you the ability to marry should marry, for it helps in lowering ones gaze and guarding one’s chastity {private parts against immorality}.
Some Virtuous of Marriage are:
- Essential for existence of human race & increasing the number of muslims
- Maintaining chastity and keeping away from unlawful sex
- Responsiblity of men toward women
- Preserves progeny
- Raises mankind above leading animalistic-life styles
Shari’ah on marriage
- Obligatory
- Desirable
- Allowable
- Prohibited
- Detestable
Obligatory...This condition lies on those who fear their sexual temptations to be stronger than their abilities to resist fornication.
Sheikh Ibn Taymiyyah r.a said, “if one is in need of marriage and he or she fears committing fornication (zina) by not marrying, then one may give priority to getting married over performing obligatory pilgrimage “Hajj”...”
Sheikh Taqiyyud-Din said, “according to the apparent view of Imam Ahmad r.a; as well as the majority of scholars, one should not consider wealth before marriage as allah says, “Holy Quran 24:32

And marry the unmarried among you and the righteous among your male slaves and female slaves. If they should be poor, Allah will enrich them from His bounty, and Allah is all-Encompassing and Knowing.
Even the prophet s.a.w once concluded a marriage for a man who couldn’t afford a dowry, making his dowry that of what he had memorized & knew of the Quran.
Desirable... When there is a desire but no fear of remaining chaste.
Allowable... When there is no lust but a desire for marriage itself.
Detestable... If it deprives the wife of her actual purpose of marriage, namely safeguarding her chastity as a husbands impotency causes a wife great harm.
Prohibited... For a Muslim man who lives in non-muslim country engaged in war with Muslims...
Abu Hurayrah r.a (a companion of the prophet s.a.w) said, “ A woman is married for four reasons:
The Prophet s.a.w said, “ you should not marry women for the sake of their beauty for it might lead them to ruin through arrogance & conceit, nor should you marry them for the sake of their wealth for it might lead them to transgression, rather you should marry them for the sake of the religiousness.” He further said while asking a companion (Jabir r.a), “why didn’t you marry a virgin so that you may play with her and that she may play with you?” This is because marrying a virgin woman involves absolute intimacy and affection, as she has no x-husband to whom her heart might be attached affecting her desire and affection for the present husband.

Men are in charge of women by [right of] what Allah has given one over the other and what they spend [for maintenance] from their wealth. So righteous women are devoutly obedient, guarding in [the husband's] absence what Allah would have them guard. But those [wives] from whom you fear arrogance - [first] advise them; [then if they persist], forsake them in bed; and [finally], strike them. But if they obey you [once more], seek no means against them. Indeed, Allah is ever Exalted and Grand.

- Let’s paint a more relevant picture in light of the additional content of the verse...the verse clearly says, “wives from which you fear arrogance.” Arrogance here translates to violent, and verbally or physically provoking towards their husbands. These types of women are a danger to themselves as well as their husbands, which brings about the divine ordination of admonition. However, striking doesn’t mean strike them in the sense of abuse, but rather it means to grab, firmly resistance or restrain them in their arrogant advances until calmness can once again be acquired, which is why the verse says, “if they obey you [once more], seek no means [further] against them [in restraint]. The Arabic is so much more richer in context and so the English often takes things out of context in translation, which is a condition to how previous revelations eventually were lost through translation until nothing remains of its original origins...Furthermore “obey” shouldn’t be taken in the context of master/slave, but rather its a mutual sharing of rights that both the husband and wife swear to fulfill through the sacred bonds of marriage...
Marriage is intended to create an environment of tranquility and companionship, mutual concord, security, and spiritual comfort.

Would you take it in injustice and manifest sin? Intercourse Allah has made lawful and a means of consummation by which a husband and wife are then bond by solemn oaths...Therefore, divorce would require the required waiting period of 3 months etc.
Holy Quran 2:235

There is no blame upon you for that to which you [indirectly] allude concerning a proposal to women or for what you conceal within yourselves. Allah knows that you will have them in mind. But do not promise them secretly except for saying a proper saying. And do not determine to undertake a marriage contract until the decreed period reaches its end. And know that Allah knows what is within yourselves, so beware of Him. And know that Allah is Forgiving and Forbearing.
- One special reason for this is the woman may be pregnant which would be confusing with new marriage before the waiting period concludes.
A muslim woman is prohibited from marrying a polytheist man i.e Christian, Hindu, Buddhist etc.
Holy Quran 2:221

And do not marry polytheistic women until they believe. And a believing slave woman is better than a polytheist, even though she might please you. And do not marry polytheistic men [to your women] until they believe. And a believing slave is better than a polytheist, even though he might please you. Those invite [you] to the Fire, but Allah invites to Paradise and to forgiveness, by His permission. And He makes clear His verses to the people that perhaps they may remember.

O you who have believed, when the believing women come to you as emigrants, examine them. Allah is most knowing as to their faith. And if you know them to be believers, then do not return them to the disbelievers; they are not lawful [wives] for them, nor are they lawful [husbands] for them. But give the disbelievers what they have spent. And there is no blame upon you if you marry them when you have given them their due compensation. Defects in a spouse
There are defects that if found in one of the two the other has the right to nullify the marriage or not.

When one chooses to exercise this right of option the execution is done by muslim judge; and if its executed prior to consummation, the woman forfeits her right to the dowry...If the guardian of the woman finds out a condition also prior to consummation they can initiate this option on the behalf & best interest of the woman.
Dowry
And give the women [upon marriage] their [bridal] gifts graciously. But if they give up willingly to you anything of it, then take it in satisfaction and ease.
The Prophet s.a.w never allowed consummation of the marriage, unless the dowry was paid in full. He said, “find something to give to her even if it be an iron ring.”
Holy Quran 4:4
- The dowry has no specified maximum or minimum; although the sunnah of the prophet s.a.w is 400 dirhams in silver like that given to his own daughter in marriage.
- The dowry can be: A wage, Rent, Property or a Service
- Sheikhul Islam Ibn Taymiyyah r.a said, “ if the dowry given is much, it is not makruh (evil) if the groom can afford to do so. However, if it is given for boasting or showing off it is considered makruh (evil). Also makruh (evil) if the dowry is acquired through begging, stealing, or on terms of deferrerment to be paid later.
- High dowries may cause the man to dislike his wife whenever he recalls the amount, especially if she turns out to be less
- The dowry is payment from the man in legality of sexual intercourse with her...its also a sign of honor showing her she is respected and he has the means to care for her.
Husband and Wife Relationship
Each of them must live kindly and faithfully with the other; none of them should with-hold the other’s rights, have an aversion, or follow it with injury or reminders...
Holy Quran 4:19
------------------
O you who have believed, it is not lawful for you to inherit women by compulsion. And do not make difficulties for them in order to take [back] part of what you gave them unless they commit a clear immorality. And live with them in kindness. For if you dislike them - perhaps you dislike a thing and Allah makes therein much good.
The Prophet s.a.w said, “The best of you is the one who treats his family the best.”
Holy Quran 66:6
------------------
O you who have believed, protect yourselves and your families from a Fire whose fuel is people and stones, over which are [appointed] angels, harsh and severe; they do not disobey Allah in what He commands them but do what they are commanded.
Holy Quran 20:132
------------------
And enjoin prayer upon your family [and people] and be steadfast therein. We ask you not for provision; We provide for you, and the [best] outcome is for [those of] righteousness.

- Prophet s.a.w said, “One should not dislike a believing woman, if he dislikes one quality, he will be pleased with another.”

And mention in the Book, Ishmael. Indeed, he was true to his promise, and he was a messenger and a prophet.
Holy Quran 19:55

And he used to enjoin on his people prayer and zakah and was to his Lord pleasing
- From the example of Isma’il a.s whom all praised with mention in the Quran; The husband is therefore responsible for the religiousness and manners of his wife as she is the one who raises his children and leads the family. If she is corrupt, then surely that corruption will show in the children...
